4 Steps To Becoming A Notary Public In Delaware

In the station of Delaware, the office of the Governor appoints notaries. Those requesting a notary commission must meet certain requirements, complete an application, obtain reference letters, pay some fees, and purchase a seal for notarizing purposes.

Step 1

You can become a notary in the dwelling of Delaware if you:

- are at least 18 years of age,

- are of good character and reputation,

- have a reasonable need for a notary commission, and

- are a lawful resident within the station of Delaware.

Non-residents can apply if they fill an office or regular place of employment in Delaware.

First-time appointments are only for two years. The fee for a two-year term is $53. Commission renewals are at $53 for two years; $78 for four years.

Step 2

Having fulfilled the requirements of Step 1, submit the following to the Secretary of State, Notary Division, 401 Federal Street, Suite 3, Dover, DE, 19901, and allow four weeks for processing:

- Completed original application (glimpse link in Resources below). Keep a copy of the completed application for your files.

- If a original applicant, you are also required to submit letters of reference to establish your character and reputation. The letters must be from two legal residents of Delaware who are not related to you and also of good character, and the letters must be in sealed envelopes on which the writer signed their name over the envelope’s sealed flap.

- Include a check or money order made payable to the Situation of Delaware. Your payment will be returned if your application is not approved.

Step 3

If everything is in order, you will receive a letter and commission certificate within four weeks. Make a copy of the certificate and have the original recorded by the Recorder of Deeds in the county in which you reside. Note: New Castle county residents must also register with the Prothonotary’s Office.

NEW CASTLE COUNTY

Recording fee of $17. If you need the Oath of Office notarized on the befriend of the notary commission, there is an additional $2 fee. One check should be made payable to “New Castle Recorder of Deeds.” Address: Recorder of Deeds Office, 800 French Street, Wilmington, DE 19801.

KENT COUNTY

Recording fee of $15 which includes notarizing the back of the commission. Check should be payable to “Kent County Recorder of Deeds.” Address: Recorder of Deeds Office, 555 Bay Road, Dover, DE 19901.

SUSSEX COUNTY

Recording fee of $19, which does not include notarizing the Oath of Office on the back of the commission, plus a $6 document surcharge. Submit two separate checks made payable to “Sussex County Recorder of Deeds.” Address: Recorder of Deeds Office, 2 The Circle, P.O. Box 827, Georgetown, DE 19947.

Step 4

You will need the notary public embossed seal or rubber stamp, and a notary receipt book, which you can glean from any office supplier. You may need to provide proof of appointment, which can be accomplished by providing them a copy of the letter and commission certificate. There may be additional stamps that would helpful for the execution of documents.
